In that they'd never truly be a part of the nation? Of course.
I guess it depends on if they're willing to let anyone have representation in their gov't besides them. And, regardless of the treaties situation, I don't think they can take what is currently private property without some sort of compensation -- wouldn't be wise to try, either. I'd rather not see fighting break out over there.
